The Platform may include listings for:

* tour operators;

Unless expressly stated otherwise, Golftreks acts as an online marketplace, advertising platform, directory and/or enquiry facilitator connecting users with independent third-party suppliers.

ACCEPTANCE OF THESE TERMS

By using Golftreks, you confirm that:

* you have read and understood these Terms;
* you agree to comply with these Terms;
* you are legally capable of entering into a binding agreement; and
* if you are using the Platform on behalf of a business or organisation, you have authority to bind that organisation to these Terms.

Users under the age of 18 should only use the Platform with the involvement and consent of a parent or legal guardian.

NATURE OF THE GOLFTREKS PLATFORM

Golftreks provides information intended to assist users in researching, comparing, discovering and enquiring about golf and travel products and services.

Information displayed on Golftreks may be:

* supplied directly by a tour operator, golf course, resort or other supplier;
* supplied by tourism boards, destination marketing organisations or travel partners;
* obtained from publicly available sources;
* uploaded by registered users;
* imported from authorised data feeds;
* created or summarised by Golftreks;
* generated as an indicative or concept travel package; or
* obtained through third-party affiliate or distribution arrangements.

Golftreks makes reasonable efforts to provide useful and accurate information but cannot guarantee that every listing, price, description, photograph, facility, availability date, golf course detail or other piece of information will always be complete, accurate or current.

Users should confirm important information directly with the relevant supplier before making travel arrangements.

CONCEPT GOLF PACKAGES

Golftreks may display golf travel packages that are identified as ‘Concept Packages’, sample itineraries, suggested trips or similar.

A Concept Package is provided for inspiration and enquiry purposes and may combine golf courses, accommodation, destinations or other travel components to illustrate a possible golf holiday.

Unless expressly stated otherwise, Concept Packages:

* are not confirmed bookings;
* may not represent a currently available package offered by a particular supplier;
* may not have live availability;
* may not include a final day-by-day itinerary;
* may contain indicative or estimated pricing;
* may be subject to changes in accommodation, golf courses, transportation or other components; and
* require confirmation by a tour operator, travel provider or Golftreks before any booking is made.

Users may be invited to select ‘Request Full Itinerary’, ‘Enquire Now’, ‘Register Interest’, ‘Book Now’, ‘Create Your Own Trip’ or a similar call-to-action.

Submitting such a request does not itself create a confirmed travel booking unless expressly stated otherwise.

PRICES AND AVAILABILITY

Prices displayed on Golftreks may be provided by third-party suppliers or may be indicative pricing for concept travel packages.

Unless expressly stated otherwise:

* prices are subject to change;
* availability is not guaranteed;
* displayed prices may be per person, per room, per package or another basis identified on the relevant listing;
* seasonal surcharges may apply;
* currency conversion rates may change;
* taxes, local fees, resort fees, golf cart fees, caddie fees, baggage fees, transfers or other charges may not be included; and
* final pricing should be confirmed prior to booking.

A price displayed on the Platform does not constitute a binding offer by Golftreks or the supplier unless expressly identified as such.

Obvious pricing, typographical or technical errors may be corrected.

CURRENCY INFORMATION

Golftreks may display prices in various currencies and may provide currency conversion tools or converted prices for convenience.

Currency conversions are indicative only.

Actual exchange rates applied by banks, payment processors, travel suppliers or credit card providers may differ from rates displayed on Golftreks.

Golftreks is not responsible for currency fluctuations, foreign exchange charges or differences between indicative and actual converted amounts.

ENQUIRIES

The Platform may allow users to send enquiries to tour operators, golf courses, resorts, travel providers or other businesses.

By submitting an enquiry, you authorise Golftreks to provide the information contained in your enquiry to the relevant supplier or other party necessary to respond to your request.

An enquiry is not normally a booking.

A booking will only exist when the relevant supplier or booking entity confirms the booking in accordance with its applicable booking conditions.

Golftreks does not guarantee that a supplier will respond to an enquiry.

BOOKINGS

Where Golftreks facilitates or enables bookings, the identity of the party responsible for providing or selling the relevant travel service will be identified during the booking process where reasonably practicable.

Depending on the product, a booking may be made:

* directly with a third-party tour operator;
* directly with a golf course;
* directly with a hotel or resort;
* through a travel agent;
* through an affiliate booking partner;
* through a third-party booking platform; or
* through Golftreks or an associated travel entity.

Additional supplier terms and booking conditions may apply.

Users should review those terms before completing a booking.

FUTURE PAYMENT AND DEPOSIT SERVICES

Golftreks may introduce functionality allowing customers to make deposits or payments through the Platform.

Where payments are accepted, specific payment, cancellation and refund terms applicable to the particular booking may be displayed before payment.

Payment processing may be provided by third-party payment processors such as Stripe or other providers.

Golftreks may not directly receive or store complete payment card information.

Where a deposit is paid, payment of the deposit does not override any supplier booking conditions disclosed to the customer.

THIRD-PARTY TRAVEL SUPPLIERS

Tour operators, golf courses, resorts, hotels, restaurants, attractions, transportation companies and other businesses appearing on Golftreks are generally independent businesses.

Unless expressly stated otherwise, these businesses are not employees, agents or representatives of Golftreks.

Golftreks is not responsible for the acts, omissions, representations, warranties, breaches, negligence or misconduct of independent suppliers.

The supplier is responsible for delivering the product or service it has agreed to provide.

AFFILIATE LINKS AND THIRD-PARTY BOOKING SERVICES

Golftreks may participate in affiliate programs and may earn commissions when users click links or complete transactions with third-party providers.

Affiliate partners may include providers of:

* accommodation;
* flights;
* tours and activities;
* rental cars;
* travel insurance;
* airport transfers;
* cruises;
* golf services; and
* other travel products.

The presence of an affiliate link does not necessarily constitute an endorsement or guarantee by Golftreks.

Transactions completed on third-party websites are governed by the terms, privacy policies and booking conditions of those third parties.

Golftreks is not responsible for the operation, availability, pricing, security or performance of third-party websites.

BUSINESS LISTINGS

Golftreks may create directory listings for golf courses, resorts, tour operators, restaurants, attractions and other relevant businesses.

Listings may be either:

* claimed;
* verified;
* premium;
* featured;
* standard;
* unclaimed; or
* another category introduced by Golftreks.

An unclaimed listing does not indicate that the listed business has entered into a commercial relationship with Golftreks.

Directory listings may contain basic publicly available information to help users locate and learn about relevant businesses.

CLAIMING A LISTING

A person seeking to claim a business listing must have authority to represent the relevant business.

Golftreks may require reasonable evidence of authority before granting control of a listing.

Golftreks may approve, reject, suspend or revoke a listing claim where:

* authority cannot be verified;
* information supplied appears inaccurate;
* there is a dispute regarding ownership or control of the listing;
* the account breaches these Terms; or
* Golftreks reasonably considers the action necessary to protect users or the integrity of the Platform.

Claiming a listing does not give the claimant ownership of Golftreks’ database, page design, URL structure or other Platform intellectual property.

LISTING INFORMATION

Businesses that claim, create or manage listings are responsible for ensuring their information is accurate and current.

This includes, where applicable:

* business names;
* addresses;
* telephone numbers;
* email addresses;
* websites;
* package descriptions;
* pricing;
* inclusions;
* dates;
* availability;
* photographs;
* course information;
* accommodation information;
* booking conditions; and
* contact details.

Golftreks may edit formatting, spelling, categories, location information or presentation to maintain consistency across the Platform.

Golftreks may also remove information that is misleading, unlawful, inappropriate or inconsistent with these Terms.

PREMIUM AND FEATURED LISTINGS

Golftreks may offer paid advertising products, including Premium Listings, Featured Listings, sponsored placements and other promotional products.

Paid placement may affect how and where a listing appears on the Platform.

Purchasing a paid listing does not guarantee:

* a particular number of enquiries;
* a particular number of bookings;
* revenue;
* search engine rankings;
* website traffic; or
* any particular commercial result.

Specific advertising agreements or order terms may apply in addition to these Terms.

LISTING RANKINGS AND SEARCH RESULTS

Golftreks may determine the ordering of search results and listings using factors including:

* listing type;
* premium or featured status;
* relevance;
* location;
* availability;
* completeness;
* popularity;
* reviews;
* verification;
* user behaviour;
* commercial relationships; and
* other ranking criteria.

Golftreks does not guarantee any listing a permanent position within search results.

Ranking systems may change at any time.

REVIEWS AND RATINGS

Golftreks may allow users to submit reviews, ratings, photographs and other content relating to golf courses, travel packages, resorts, tour operators and other businesses.

By submitting a review, you confirm that:

* the review reflects your genuine experience or opinion;
* you have not intentionally submitted false or misleading information;
* you are not impersonating another person;
* you have disclosed any material commercial relationship where appropriate;
* your content does not violate another person’s rights; and
* your review complies with applicable law.

Golftreks may moderate, reject or remove reviews that it reasonably considers:

* fraudulent;
* abusive;
* defamatory;
* discriminatory;
* irrelevant;
* spam;
* commercially manipulated;
* submitted in exchange for improper incentives; or
* otherwise inconsistent with these Terms.

Golftreks does not necessarily endorse opinions contained in user reviews.

USER-GENERATED CONTENT

Users and businesses may submit photographs, descriptions, reviews, itineraries, logos, documents and other materials (“User Content”).

You retain ownership of rights you hold in your User Content.

By uploading or submitting User Content to Golftreks, you grant Golftreks a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, format, adapt and distribute that content for purposes connected with operating, promoting and improving the Platform.

You confirm that you have the necessary rights and permissions to provide the User Content.

The licence ends when the content is removed from Golftreks, except to the extent copies are reasonably retained in backups, archives, promotional materials already produced or where continued retention is required by law.

IMAGES AND PHOTOGRAPHS

Images displayed on Golftreks may be supplied by:

* tour operators;
* golf courses;
* hotels and resorts;
* tourism boards;
* destination marketing organisations;
* travel centres;
* suppliers;
* photographers;
* users;
* data partners; or
* other authorised sources.

Images may also be associated with directory information sourced from publicly available materials where Golftreks reasonably understands that the material may be used for informational or promotional purposes.

Golftreks respects intellectual property rights.

If an image has been uploaded, supplied or displayed in error, the rights holder may contact Golftreks requesting review or removal.

Golftreks will investigate reasonable requests and, where appropriate, remove or replace the relevant material.

INTELLECTUAL PROPERTY

Except for content owned by third parties or users, all rights in the Golftreks Platform and its content are owned by or licensed to Golftreks.

This includes, where applicable:

* graphics;
* text;
* taxonomy structures;
* search functionality;
* listing templates;
* page layouts;
* business methods; and
* original content.

You may use the Platform for personal or legitimate business purposes in accordance with these Terms.

You may not, without permission:

* reproduce substantial portions of the Platform;
* scrape or harvest listings at scale;
* create a competing database using Golftreks content;
* republish Golftreks content commercially;
* reverse engineer Platform software;
* remove copyright or trademark notices; or
* falsely imply an association with Golftreks.

AUTOMATED ACCESS AND DATA SCRAPING

You must not use bots, crawlers, scripts, artificial intelligence systems, automated extraction tools or similar technologies to systematically extract content from Golftreks without prior written permission.

Reasonable access by recognised search engines for indexing purposes may be permitted.

Golftreks may block automated traffic or accounts that it reasonably considers harmful to the Platform.

ACCOUNTS

Certain Platform features may require an account.

You are responsible for:

* providing accurate registration information;
* maintaining the security of your password;
* protecting access to your account; and
* notifying Golftreks if you believe your account has been compromised.

You are responsible for activity conducted through your account unless the activity arose because of circumstances for which you are not legally responsible.

* in any way reasonably likely to damage Golftreks, its users or suppliers.

TOUR OPERATOR AND SUPPLIER RESPONSIBILITIES

Businesses submitting listings or packages to Golftreks are responsible for ensuring that:

* they are legally entitled to offer the advertised products or services;
* information supplied is accurate;
* advertised prices are not deliberately misleading;
* licences and registrations required for their business are maintained;
* customer enquiries are handled appropriately;
* required insurance is maintained;
* bookings are delivered in accordance with agreed terms; and
* they comply with applicable consumer, travel, advertising and privacy laws.

Golftreks may remove suppliers that repeatedly receive serious complaints or otherwise present an unreasonable risk to users.

VERIFICATION

Golftreks may identify certain listings, operators, packages or businesses as “Verified” or use similar terminology.

Verification means only that Golftreks has completed the verification procedure applicable at that time.

It does not constitute a guarantee regarding:

* financial stability;
* service quality;
* safety;
* suitability;
* future performance; or
* compliance with every applicable law.

Users should make their own enquiries before entering into significant transactions.

MAPS AND LOCATION INFORMATION

Golftreks may display maps, addresses, coordinates or location information.

Location information may be supplied by third parties and may occasionally be inaccurate.

Users should independently confirm addresses and directions where important.

Map services may also be subject to separate terms imposed by third-party map providers.

TRAVEL RISKS

Travel involves risks that may be outside the control of Golftreks.

These may include:

* weather;
* natural disasters;
* political events;
* border restrictions;
* visa requirements;
* strikes;
* flight disruptions;
* illness;
* injury;
* golf course closures;
* tournament schedules;
* maintenance;
* transportation disruptions; and
* supplier insolvency or operational changes.

Users are responsible for considering travel advisories, insurance, visas, passport validity, health requirements and other relevant travel matters.

GOLF-RELATED INFORMATION

Golf course information such as course length, par, number of holes, designers, facilities, green fees, golf cart policies, caddie requirements, dress codes and opening hours may change.

Users should confirm important course information directly with the relevant golf course before travelling.

Course conditions may also vary because of weather, maintenance, tournaments or other circumstances.

TRAVEL INSURANCE

Golftreks strongly recommends that travellers consider appropriate travel insurance for their circumstances.

Travel insurance may cover matters including cancellation, medical expenses, lost luggage, travel disruption and other risks, depending on the policy.

Golftreks does not guarantee that any particular insurance policy will cover a specific event.

Users should review the relevant product disclosure statement, policy wording and exclusions.

PASSPORTS, VISAS AND ENTRY REQUIREMENTS

Users are responsible for determining and satisfying all passport, visa, vaccination, health, customs and immigration requirements applicable to their travel.

Requirements may vary according to citizenship, residency, destination and personal circumstances.

Golftreks does not accept responsibility for a traveller being refused entry to a destination because required travel documentation has not been obtained.

THIRD-PARTY WEBSITES

* privacy practices;
* accuracy; or
* products and services.

Golftreks does not warrant that:

* every supplier will respond;
* every advertised service will remain available;
* the Platform will operate without interruption; or
* the Platform will be free from all technical or security issues.

Nothing in these Terms excludes warranties, guarantees or rights that cannot lawfully be excluded.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Golftreks will not be liable for indirect, incidental, consequential or special losses arising from use of the Platform, including loss of profits, business opportunities, goodwill or anticipated savings.

Golftreks is not responsible for losses caused by independent suppliers, including failures relating to accommodation, golf courses, transportation, tour operators, restaurants, attractions or other travel providers, except to the extent Golftreks is legally responsible.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

AUSTRALIAN CONSUMER LAW

Where the Australian Consumer Law applies, nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where liability may lawfully be limited, Golftreks may limit its liability to the extent permitted by applicable law.

FORCE MAJEURE

Golftreks will not be responsible for delays or failures caused by events reasonably outside its control.

INDEMNITY

To the extent permitted by law, businesses, suppliers and users who submit content to Golftreks agree to indemnify Golftreks against third-party claims arising directly from:

* content they supplied without proper authority;
* infringement of third-party intellectual property rights;
* unlawful activity;
* fraudulent information; or
* material breaches of these Terms.

This obligation does not apply to losses caused by Golftreks’ own unlawful conduct.

SUSPENSION AND TERMINATION

Golftreks may suspend or terminate access to the Platform where Golftreks reasonably believes that:

* these Terms have been breached;
* fraudulent activity has occurred;
* another user’s security is threatened;
* unlawful conduct has occurred;
* continued access may harm the Platform; or

REMOVAL OF LISTINGS

Golftreks may remove, suspend or amend a listing where:

* information appears materially inaccurate;
* the business has permanently closed;
* intellectual property concerns arise;
* the listing breaches these Terms;
* a legitimate rights holder requests removal;
* fraudulent activity is suspected; or
* Golftreks reasonably considers removal necessary.

Businesses may contact Golftreks regarding incorrect or outdated information.

COPYRIGHT AND INTELLECTUAL PROPERTY COMPLAINTS

Golftreks respects the rights of copyright and intellectual property owners.

If you believe content displayed on the Platform infringes your rights, please contact Golftreks and provide sufficient information to identify:

* the protected work;
* the allegedly infringing material;
* its location on Golftreks;
* your authority or ownership interest; and
* your contact information.

Golftreks will review reasonable complaints and may remove content while a matter is investigated.

COMPLAINTS

Users who have concerns regarding the Platform should contact Golftreks in the first instance.

Where a complaint relates primarily to a service provided by an independent supplier, Golftreks may refer the customer to that supplier.

Golftreks may assist communication between the parties but does not necessarily assume responsibility for resolving disputes between independent users and suppliers.

DISPUTES BETWEEN USERS AND SUPPLIERS

Any agreement entered into directly between a traveller and an independent supplier is generally between those parties.

Golftreks may provide information or reasonable assistance but is not required to adjudicate private contractual disputes between third parties.

INTERNATIONAL USE

Golftreks is intended for an international audience.

Users are responsible for ensuring that their use of the Platform complies with laws applicable to them.

The availability of a listing in a particular country does not mean Golftreks represents that the listing complies with every regulatory requirement applicable in that jurisdiction.

GOVERNING LAW

Unless mandatory laws require otherwise, these Terms are governed by the laws applicable in Queensland, Australia.

You submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.

Where Golftreks operates through another legal entity or where specific booking terms nominate another jurisdiction, those specific terms may govern the relevant transaction.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

The invalid provision will, where possible, be interpreted or modified only to the extent necessary to make it enforceable.

NO WAIVER

If Golftreks does not immediately enforce a right under these Terms, that does not mean Golftreks has waived that right.

ASSIGNMENT

Users may not transfer their rights or obligations under these Terms without Golftreks’ consent.

Golftreks may transfer its rights and obligations as part of a corporate restructure, business sale, merger or similar transaction, subject to applicable law.

ENTIRE AGREEMENT

These Terms, together with any applicable:

* Privacy Policy;
* Cookie Policy;
* Image Use Policy;
* Supplier or Listing Terms;
* booking conditions;
* payment terms; and
* other policies expressly incorporated by reference,

constitute the agreement governing use of the Platform.

Where specific booking or supplier terms conflict with these general Terms, the specific terms will apply to the relevant transaction to the extent of the inconsistency.
